1. Introduction and Scope
1.1. About Bloomy Earth
Bloomy Earth is a digital platform operated by Leading Change, a French company headquartered at 7 Avenue Jean Jaurès, 91600 Savigny-sur-Orge, France EU VAT Id: FR28979412368. These Terms of Service and Acceptable Use Policy (“Terms”) govern your access to and use of:
– the Bloomy Earth website available at https://www.bloomy.earth,
– the user dashboard and community spaces,
– the tree-planting and carbon-impact features,
– the certificates (including optional VCS-related features),
– the API and automation tools,
– the integrations, plugins, widgets, scripts, and any related technologies,
collectively referred to as the “Platform” or the “Products”.

1.2. Scope of these Terms
These Terms apply to all visitors, registered users, organisations, partners, and any entity accessing the Platform directly or indirectly. By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and all applicable laws and regulations.
If you do not agree with these Terms, you must discontinue using the Platform immediately.
1.3. Relationship with Other Policies
Your use of the Platform is also subject to:
– our Privacy Policy,
– our Cookie Policy,
– any Data Processing Agreement (DPA) applicable to Organisation Users,
– any specific commercial or partnership contracts you may have with Bloomy Earth.
In the event of conflict, the specific terms of a commercial contract or DPA prevail over these general Terms.
2. Eligibility, Minors and User Categories
2.1. Age and Legal Capacity
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Platform.
Minors may only use the Platform under the direct supervision of a parent or legal guardian, who remains fully responsible for the minor’s activity.
2.2. User Types
Depending on your use of the Platform, you fall into one of the following categories:
– Individual Users: private individuals using Bloomy Earth for personal actions or to manage personal planting activities.
– Organisation Users: companies, NGOs, institutions or any legal entity using Bloomy Earth for business, CSR, climate-impact communication, tree credits, team engagement, or API use.
– Project Partners (future feature): organisations or entities collaborating with Bloomy Earth to provide reforestation data or project-related content.
Certain features, such as the API, Employees dashboards, business certificates or commercial integrations, are available only to Organisation Users.
2.3. Representatives of Organisations
When creating or managing an account on behalf of an organisation, you represent and warrant that:
– you are authorised to act for and bind that organisation,
– the organisation accepts these Terms,
– you will ensure that all authorised users comply with these Terms.
The organisation remains fully responsible for all activity performed through its account, including actions of employees, contractors, agencies, or other authorised delegates.
3. Account Registration, Security and Management
3.1. Creating an Account
To access certain features, you must create an account and provide accurate, complete, and up-to-date information. You agree not to:
– create an account using false information,
– impersonate any individual or organisation,
– create multiple accounts for abusive or deceptive purposes.
You agree to update your information promptly if it changes.
3.2. Credentials, API Keys and Security
You are responsible for maintaining the confidentiality and security of:
– your login credentials,
– your API keys or authentication tokens,
– any automation credentials used in integrations (such as Zapier, n8n, Albato or similar tools).
You are solely responsible for any activity performed through your account. If you suspect unauthorised access, you must notify us immediately at [email protected].
For Organisation Users, the organisation is responsible for managing its internal user permissions and removing access for former employees, contractors or other third parties who no longer require access.
3.3. Organisation Accounts and Delegated Users
Organisation accounts may allow multiple authorised users from the same entity. The organisation:
– remains fully liable for the actions of all delegated users,
– must ensure compliance with its internal policies,
– must maintain up-to-date user access lists,
– must remove access for users who no longer represent the organisation.
3.4. Account Misuse
Bloomy Earth may suspend, restrict, or terminate access to any account, without obligation to refund, if:
– the account engages in prohibited activities,
– the account compromises Platform security,
– the user violates these Terms,
– the behaviour threatens other users or the integrity of the Platform.
Suspension or termination may occur without prior notice where security or legal risks are identified.
3.5. Account Closure and Data Retention
You may request closure of your account at any time.
Upon closure:
– personal data will be deleted or anonymised in accordance with applicable data protection laws, including GDPR,
– legally-required data (including billing, accounting and audit data) may be retained for the statutory period,
– public impact records and certificates previously issued may remain accessible, as they serve as proof of planting and project integrity,
– community posts may remain visible unless removed by you before closure.
Bloomy Earth has no obligation to restore deleted data once an account has been closed.
4. Bloomy Earth Content and Intellectual Property
4.1. Bloomy Earth Content
All content made available through the Platform is owned by or licensed to Bloomy Earth by Leading Change. This includes, without limitation, text, images, graphics, videos, certificates, badges, widgets, dashboards, project information, APIs, scripts, documentation, and all software components.
Access to the Platform does not grant ownership of any intellectual property rights. All rights not expressly granted are reserved.
4.2. Licence Granted to Users
Bloomy Earth grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform in accordance with these Terms. Organisation Users may use certificates, badges, widgets and visuals provided by Bloomy Earth solely for legitimate communication linked to their contributions.
4.3. Restrictions
You agree not to:
– reproduce, copy, distribute, sell, lease or sublicense Platform content,
– modify or alter any certificates or impact visuals in a misleading way,
– remove or obscure legal notices or attributions,
– reverse engineer, decompile or attempt to extract source code,
– use any automated tools to scrape or harvest Platform data in bulk,
– publish derivative works that misrepresent Bloomy Earth or its partners.
4.4. Use of Certificates, Badges and Visual Assets
Certificates, visuals, badges and impact widgets provided through the Platform may be used in your communications, provided that:
– factual information (trees planted, dates, projects, quantities) is not altered,
– branding elements, QR codes and identifiers remain intact,
– visuals are not used to mislead or imply certifications that Bloomy Earth does not provide,
– usage complies with all applicable advertising and environmental-marketing laws.
5. User-Generated Content and Community Spaces
5.1. Definition of User Content
User Content includes any material you upload, submit or publish through the Platform. This may include posts, comments, images, project discussions, organisation descriptions, profile information, or any content added to the community spaces or your public/organisation forest.
5.2. Ownership and Licence
You retain ownership of your User Content. However, by submitting User Content, you grant Bloomy Earth a worldwide, royalty-free, perpetual, transferable licence to use, host, store, reproduce, adapt, translate, publish, distribute, display and create derivative works from your content, for the operation and promotion of the Platform.
This licence includes the right to use User Content in marketing materials, case studies, educational content and public impact pages.
5.3. Non-Confidentiality
User Content published in public areas is considered non-confidential. Bloomy Earth has no obligation to protect such content from disclosure.
5.4. Responsibility for User Content
You are solely responsible for your User Content and warrant that it:
– is accurate and lawful,
– does not infringe the rights of others (including copyright, trademarks, privacy or data protection),
– does not include malware, harmful code, or any form of malicious software,
– complies with all applicable laws and these Terms.
5.5. Moderation and Removal
Bloomy Earth may remove, edit, restrict, or block access to any User Content at our sole discretion if it violates these Terms, applicable laws, or poses a risk to the Platform or its users.
Bloomy Earth may also limit or restrict access to certain features for accounts repeatedly violating community or safety rules.
6. Acceptable Use Policy
6.1. General Obligations
You agree to use the Platform responsibly, in good faith, and in compliance with all applicable laws. Any misuse of the Platform, community spaces, API or automation tools is prohibited.
6.2. Security and Integrity of the Platform
You must not attempt to compromise the Platform’s integrity. Prohibited actions include:
– attempting to breach security systems or authentication measures,
– scanning, probing or testing the Platform for vulnerabilities,
– bypassing or circumventing rate limits or technical restrictions,
– launching DDoS attacks, flooding or disrupting normal service operation,
– using automation or bots in ways not authorised by Bloomy Earth.
6.3. Prohibited Content
You must not publish, share or upload content that is:
– violent, hateful, racist, xenophobic or discriminatory,
– defamatory, harassing or threatening,
– sexually explicit or harmful to minors,
– promoting self-harm, extremism, terrorism or criminal activity,
– misleading, fraudulent or otherwise unlawful.
6.4. Protection of Minors
You must not publish content inappropriate for minors. Any material involving or exploiting minors in any form is strictly prohibited and may be reported to relevant authorities.
6.5. Spam and Unwanted Communications
You agree not to:
– use Bloomy Earth messaging or community spaces for advertising or solicitation,
– send unsolicited commercial messages,
– collect emails or user data without clear consent,
– use the Platform to operate or support spam campaigns.
6.6. Misuse of Accounts and Impersonation
You must not impersonate any person or organisation, including Bloomy Earth. creating false identities or suggesting false partnerships is prohibited.
6.7. Unlawful Activities
You agree not to use the Platform for illegal activities, including but not limited to fraud, money laundering, financing of unlawful activities, or handling of prohibited transactions.
7. Projects, Certificates and Climate-Related Claims
7.1. Nature of Bloomy Earth Services
Bloomy Earth provides digital tools that support reforestation, tree-planting initiatives, estimation of environmental impact, and generation of planting certificates. The Platform connects users with vetted reforestation partners and processes planting data supplied by these external contributors.
Bloomy Earth facilitates access to impact information but does not guarantee specific environmental outcomes or exact carbon-related performance. All impact values reflect the best available data at the time of calculation.
7.2. Data Sources and Estimates
Environmental metrics such as estimated CO₂ contribution, project density, reforested area or growth projections are based on calculations provided by project partners, historical datasets, scientific references or internal methodologies. These values are estimates only and may evolve over time.
You acknowledge that metrics may be updated due to improvements in scientific methods, field conditions, partner updates, regulatory guidance or quality-control reviews.
7.3. No Regulatory or Financial Guarantees
Unless specifically stated for a particular product, Bloomy Earth certificates are informational in nature and are not:
– regulated carbon credits,
– financial instruments,
– investment products,
– compliance-grade offsets recognised under governmental schemes.
Certificates do not, by themselves, ensure compliance with environmental or carbon-reporting regulations applicable to your organisation.
7.4. Responsibility for Marketing and Public Claims
You are solely responsible for any statements, environmental claims, marketing messages or carbon-related representations you make to clients, partners or the public. Bloomy Earth does not review or validate such claims.
You must ensure that any communication referring to your climate actions complies with applicable laws, advertising standards, consumer-protection rules and environmental-marketing guidance in your jurisdiction.
7.5. Uncertainties and External Events
Reforestation projects involve natural variability. Bloomy Earth is not responsible for changes in outcomes due to:
– droughts, fires or natural disasters,
– land-management changes by local authorities or partners,
– updated scientific assumptions or methodological reviews,
– operational adjustments by project implementers.
Bloomy Earth will make reasonable efforts to keep data accurate and updated when significant changes occur.
8. API, Integrations and Automations
8.1. API Access and Credentials
Organisation Users may access the Bloomy Earth API to automate tree-planting actions, create certificates, fetch data or integrate climate-impact features into their systems. API keys, Basic Auth credentials and tokens must be kept strictly confidential.
Any action performed with issued API credentials is deemed to originate from the account owner. The account owner is fully responsible for all usage, whether authorised or not.
8.2. Permitted Use
The API may be used to:
– create planting actions and certificates,
– fetch project and impact information,
– automate business workflows using tools such as Zapier, n8n, Albato or custom scripts,
– integrate Bloomy Earth visuals or data into websites, applications or dashboards.
8.3. Prohibited Use
You may not use the API to:
– copy or replicate Bloomy Earth services to build a competing product,
– perform load testing, stress testing or security scanning,
– bypass pricing rules, membership restrictions or fair-use limits,
– interfere with or degrade Platform performance,
– collect data about users without their explicit consent,
– store certificates or data in a misleading or manipulated form.
8.4. Rate Limits and Fair Use
Bloomy Earth may apply rate limits or usage quotas to ensure Platform stability. Excessive or abusive usage, as determined at Bloomy Earth’s discretion, may result in API throttling, temporary suspension or revocation of credentials.
8.5. Third-Party Integrations
Bloomy Earth integrates with external services (including Zapier, n8n, Albato, WordPress plugins and similar tools). These are offered “as available” and may depend on third-party performance.
Bloomy Earth is not responsible for outages, delays, data loss or misconfigurations arising from these external tools.
9. Payment, Billing and Tax
9.1. Plans, Pricing and Changes
Bloomy Earth may offer free and paid plans for individuals and organisations. Pricing, features and service levels may change from time to time. Changes will apply from the date of publication unless otherwise stated.
9.2. Billing and Taxes
All prices displayed on the Platform may be shown before or after tax depending on the billing context. Applicable VAT or other taxes will be added based on your billing country and tax rules.
You are responsible for providing accurate billing information and ensuring that payments are completed on time. Failure to pay may lead to account suspension.
9.3. Non-Payment, Chargebacks and Suspension
If a payment fails or a chargeback occurs, Bloomy Earth may suspend or limit your access to paid features. Repeated payment issues may result in account termination.
Bloomy Earth may seek reimbursement for chargeback fees or financial losses resulting from fraudulent or improper payment activity.
10. Legal Responsibility, Warranties and Disclaimers
10.1. “As Is” and “As Available”
The Platform and all associated services, integrations, APIs and generated materials are provided on an “as is” and “as available” basis. Bloomy Earth does not guarantee uninterrupted access, error-free operation, or permanent availability of any feature.
10.2. No Warranties
To the maximum extent permitted by law, Bloomy Earth disclaims all warranties, whether express or implied, including:
– merchantability,
– fitness for a particular purpose,
– non-infringement,
– accuracy or reliability of environmental metrics,
– suitability of certificates for regulatory reporting.
The Platform may experience interruptions, maintenance, service updates or failures caused by external providers. Bloomy Earth is not liable for these disruptions.
10.3. Limitation of Liability
To the fullest extent permitted by applicable law, Bloomy Earth shall not be liable for:
– indirect, incidental or consequential damages,
– loss of revenue, profits or business opportunities,
– damage to reputation or loss of goodwill,
– loss or corruption of data,
– environmental or regulatory claims based on user communication,
– damages arising from user reliance on estimates or projections.
Bloomy Earth’s total aggregate liability for any claim arising from the use of the Platform shall not exceed the total amount paid by the user during the six (6) months preceding the event giving rise to the claim.
10.4. Third-Party Services and External Links
The Platform may contain links to third-party websites or resources. These links are provided for convenience only.
Bloomy Earth does not control, endorse, monitor or guarantee the content, availability, accuracy or security of any external websites.
Accessing third-party websites is entirely at your own risk.
Bloomy Earth disclaims all responsibility and liability for any damage or loss, whether direct or indirect, arising from your use of or reliance on content, services or resources provided by third parties. This includes any legal, technical, financial or reputational consequences linked to such external sites.
If you believe that a linked website contains unlawful, harmful or inappropriate content, you may notify us using the contact details provided in these Terms so that we can review the situation and take appropriate measures.
11. Notice and Takedown Procedure (Illicit or Infringing Content)
11.1. Reporting Mechanism
If you believe that content available on the Platform is illegal, harmful or infringing upon your rights, you may submit a notice by contacting:

11.2. Investigation and Action
Bloomy Earth will review notices in good faith. If the content appears unlawful or violates these Terms, Bloomy Earth may remove it, disable access to it, request additional information, or suspend the account responsible.
Bloomy Earth reserves the right to forward the notice to the user involved and, if necessary, to relevant authorities.
11.3. No Guarantee of Specific Outcome
Bloomy Earth does not guarantee response times or specific outcomes. However, reasonable efforts will be made to process legitimate notices promptly.
12. Suspension, Termination and Effects
12.1. Suspension and Termination by Bloomy Earth
Bloomy Earth may suspend or terminate an account at its sole discretion if:
– the user violates these Terms,
– the account poses a security or operational risk,
– fraudulent, abusive or illegal activity is detected,
– required payments are not made,
– the user misuses certificates, trademarks or branding.
Immediate termination may occur without prior notice in severe cases.
12.2. Termination by the User
Users may terminate their account at any time through the Platform’s account settings or by contacting support.
12.3. Consequences of Termination
Upon termination:
– access to the Platform is revoked,
– generated certificates remain valid as proof of planting,
– public impact pages or forests may remain visible,
– personal data may be deleted or anonymised except when retention is required by law,
– Bloomy Earth has no obligation to restore deleted data,
– any outstanding payments or obligations remain due.
13. Changes to the Terms
13.1. Right to Modify
Bloomy Earth may update or amend these Terms at any time. Changes will take effect upon publication unless otherwise specified.
13.2. Notice of Changes
Bloomy Earth may notify users through email, in-app notices or banners for material changes. Minor or administrative updates may be applied without direct notice.
13.3. Continued Use
Continued use of the Platform after the effective date of revised Terms constitutes acceptance of the updated version.
14. Governing Law, Jurisdiction and Miscellaneous
14.1. Governing Law
These Terms are governed by the laws of France, without regard to conflict-of-law rules.
14.2. Jurisdiction
Any legal dispute shall be submitted to the competent courts located in France, unless mandatory consumer-protection laws require otherwise.
14.3. Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.
14.4. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy and any applicable DPA or commercial agreements, constitute the entire agreement between you and Bloomy Earth.
